Article 1: General provisions
The e-commerce website of ZIRAFFA GCV, on this website with call sign Stien Michiels / STI.LL, an ordinary limited partnership with registered offices at Rassonstraat 47, 1030 Schaerbeek, VAT BE0892 489 278 (hereinafter "Ziraffa") offers its clients the possibility of purchasing the products in its web shop online.
These general terms and conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Client"). When placing an order via Ziraffa's webshop, the Customer must expressly accept these Conditions, thereby agreeing to their applicability to the exclusion of all other conditions. Additional conditions of the client are excluded, unless they have been previously accepted by Ziraffa in writing and expressly.
Article 2: Price
All prices stated are in EURO and always include VAT and all other duties or taxes that the Customer is obliged to pay. Shipping costs are charged depending on the destination of the product.
Belgium: free shipping (for a value of 2,14 euro)
Rest of Europe and UK: 3,41 euro (BPost rate 5,55 euro minus 2,14 euro)
The price stated refers exclusively to the articles as described word for word. The accompanying photos are intended for decoration and may contain elements that are not included in the price.
Article 3: Offers
Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Ziraffa.
Ziraffa is only bound to a best-efforts obligation as regards the correctness and completeness of the information offered.
Ziraffa is not liable in any case of obvious material errors, misprints or printing errors.
If the customer has specific questions, e.g. about sizes, colour, availability, delivery period or method, the customer is requested to contact email@example.com / 0032 497 02 36 40 in advance.
The offer is valid while stocks last and can be adjusted or withdrawn by Ziraffa at any time. Ziraffa cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this is explicitly stated in the offer.
Article 4: Online purchases
For a smooth and correct handling, we ask you always to order the product through our webshop first, by doing so we also have the data to contact you for further handling. How to order?

PayPal With a PayPal account you can pay securely on the PayPal site. You only have to select PayPal when paying. You will then be asked to log in to your PayPal account and confirm the payment. Your financial data will never be shown to webshops. Opening a PayPal account is free and we do not charge any extra costs for paying with PayPal.
Credit card Paying with a credit card (Euro/Master card and VISA) is also no problem. We use the 3D-Secure "Verified by Visa" or "MasterCard SecureCode" method of credit card payment.

Article 5: Delivery and execution of the agreement
Articles ordered via this web shop are delivered in Belgium, Denmark, Germany, France, Greece, Ireland, Italy, Luxembourg, the Netherlands, Spain and the UK. When placing your order, we use the following shipping method: BPOST, letter - non-standard format. Delivery time: 4 to 5 working days. (In case of pre-order: 4 to 5 working days from release date)
Unless otherwise agreed or expressly provided, the goods shall be delivered to the Customer's place of residence within 30 days of receipt of the order. Any visible damage and/or qualitative shortcomings of an article or other shortcomings in the delivery must be reported by the Customer to Ziraffa without delay. The risk of loss or damage shall pass to the Customer as soon as he (or a third party appointed by him, who is not the carrier) has received physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Ziraffa.
Article 6: Retention of title
The delivered goods remain the exclusive property of Ziraffa until the moment of full payment by the Customer. The Customer undertakes, if necessary, to draw the attention of third parties to Ziraffa's retention of title, e.g. to anyone who may come to seize the articles that have not yet been paid for in full.
Article 7: Right of withdrawal
The provisions of this article apply only to clients who, in their capacity as consumers, purchase articles online from Ziraffa. If the right of withdrawal is applicable: The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party appointed by the Customer, who is not the carrier, takes physical possession of the goods. To exercise the right of withdrawal, the Client must inform Ziraffa GCV (rue Rasson 47, 1030 Schaerbeek, 0032497023640, firstname.lastname@example.org) of his decision to withdraw from the contract by an unequivocal statement (e.g. written post, fax or e-mail).
The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so. In order to meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer shall return or hand over the goods to Ziraffa GCV, rue Rasson 47, 1030 Schaerbeek, without delay and in any event not later than 14 calendar days from the day on which he communicated his decision to withdraw from the contract to [name of the company].
The Customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods will be borne by the Customer. If the returned product has depreciated in any way,
Ziraffa reserves the right to hold the Customer liable and claim compensation for any depreciation in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase may be returned.
If the Customer withdraws from the contract, Ziraffa shall reimburse the Customer for all payments received from the Customer up to that point, including standard delivery charges, within a maximum of 14 calendar days of Ziraffa being informed of the Customer's decision to withdraw from the contract.
In the case of sales contracts, Ziraffa may delay repayment until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.
Any additional costs incurred as a result of the Customer opting for a method of delivery other than the cheapest standard delivery offered by Ziraffa shall not be refunded.
Ziraffa shall reimburse the Client with the same means of payment with which the Client carried out the original transaction, unless the Client has expressly agreed otherwise; in any event, the Client shall not be charged for such reimbursement. If the right of withdrawal does not apply, state why on the basis of the following categories:
The Customer cannot exercise the right of withdrawal for the supply of digital content which is not supplied on a tangible medium, if the performance has begun with the Customer's express prior consent and provided the Customer has acknowledged that he thereby loses his right of withdrawal (e.g. downloading music, software);
Article 8: Guarantee
Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee leaves these rights intact.
In order to make a claim under the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods. For articles purchased online and delivered to the Customer's home, the Customer must contact Ziraffa and return the article to Ziraffa at his own expense.
If a defect is found, the Client must inform Ziraffa as soon as possible. In any event, any defect must be notified within a period of 2 months from its detection by the Client. After this period, any right to repair or replacement lapses.
The (commercial and/or legal) guarantee is never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not deemed to be hidden defects, unless the Customer can prove otherwise.

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to Ziraffa, in the event of non-payment or late payment, the Client shall be liable, ipso jure and without warning, to interest of 10% per annum on the unpaid amount from the date of the default. In addition, the Client shall be liable, ipso jure and without notice, to lump-sum compensation of 10% of the amount in question, with a minimum of EUR 25 per invoice. Without prejudice to the above, Ziraffa reserves the right to take back articles that have not been paid for (in full).
Article 11: Privacy
The controller, Ziraffa GCV, respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.
The personal data communicated by you will only be used for the following purposes:
- the execution of the contract concluded and the processing of the order.
- Provided that you have given your express consent, the data will also be used for sending newsletters, advertising and/or marketing purposes.
You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of your identity card), you can obtain a written, dated and signed request to Ziraffa GCV, Rassonstraat 47, 1030 Schaarbeek, firstname.lastname@example.org, free of charge, for the written communication of your personal details.
If necessary, you can also ask to correct the data that are incorrect, incomplete or irrelevant.

We treat your details as confidential information and will not pass them on, rent or sell them to third parties. The client is responsible for keeping his login data confidential and for the use of his password.

Failure at any time by Ziraffa to enforce any of the rights listed in these Conditions, or to exercise any of them, shall never be regarded as a waiver of such a provision and shall not affect the validity of these rights.
Article 14: Amendment of terms and conditions
These conditions are supplemented by other conditions which are explicitly referred to, and the general conditions of sale of Ziraffa. In the event of contradiction, the present conditions shall prevail.
Article 15: Proof
The Client accepts that electronic communications and back-ups can serve as proof.
Article 16: Applicable law - Disputes
Belgian law shall apply, with the exception of the provisions of international private law concerning applicable law. The courts of the Consumer's place of residence are competent in case of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
